Actor Johnny Lewis not on drugs at time of death: coroner

LOS ANGELES (Reuters) - Former "Sons of Anarchy" actor Johnny Lewis, who was found dead in September and linked to a suspected homicide, did not have any drugs or alcohol in his body, coroner's officials said on Friday.

A toxicology examination detected no amounts of cocaine, marijuana, hallucinogenic drugs or prescription medications, the Los Angeles County Coroner's office said in a report.

Lewis, 28, was found dead in the driveway of a home he had been renting in Los Angeles and his 81-year-old landlady was found dead inside.

Investigators initially suspected Lewis was under the influence of drugs or alcohol because he had spent time in rehab and had a criminal drug past. The actor had been released from jail five days prior to his death.

Authorities ruled Lewis' death an accident from partial strangulation and head trauma after the actor fell 15 feet from an elevated terrace onto a paved driveway.

"We do not have definitive evidence that (Lewis) intended to kill himself," Los Angeles County medical examiner James K. Ribe wrote in the autopsy report. "We also do not at this time have any evidence that he was pushed."

Detectives believe Lewis may have killed his landlady, Catherine Davis, but said the motive was unknown.

Lewis had pleaded guilty in August to assault with a deadly weapon. He also pleaded no contest to an attempted burglary in a separate case. He was sentenced to jail in both cases.

Lewis played Kip "Half Sack" Epps, an Iraq War veteran, in the first two seasons of FX television drama "Sons of Anarchy" about an outlaw motorcycle club. The Los Angeles-born actor previously had recurring roles in the TV shows "Boston Public" and "The O.C."

Federal prisons urged to grant more early releases

NEW YORK (AP) ? For humanitarian and economic reasons, the federal Bureau of Prisons should grant more early releases to incapacitated and terminally ill prisoners, two advocacy groups say in a report depicting current policies as sometimes "cruel as well as senseless."

The report, issued Friday by Human Rights Watch and Families Against Mandatory Minimums, says the Bureau of Prisons oversees more than 218,000 inmates, yet has recommended an average of only two dozen compassionate releases a year since 1992.

Human Rights Watch senior adviser Jamie Fellner, a co-author of the report, said Congress in 1984 granted federal courts the authority to reduce sentences under "extraordinary and compelling" circumstances. However, the report says federal prisoners can't seek such a sentence reduction from the courts on their own; only the BOP has the authority to file a motion requesting judicial consideration of early release.

"Justice sometimes requires compassion, even for people who have broken the law," Fellner said. "But prison officials prevent judges from deciding when compassion requires a sentence reduction. This is unfair to the prisoners and costly to the country."

Responding by email, the BOP said it reviews each early-release request on a case-by-case basis and also takes into consideration information provided by the U.S. Attorney's Office.

"It is the bureau's responsibility to consider public safety" when determining whether to pursue these motions, the BOP statement said.

Though the new report is generally critical of BOP policies, it cites some "promising signs" ? including formation of a BOP working group to look at the compassionate release program. It said the BOP's new director, Charles Samuels, has expressed interest in reforming the program and noted that the number of release cases forwarded to the courts had risen slightly under his leadership, to 37 between Jan. 1 and Nov. 15 of this year.

The report urges Congress to change the existing law, which gives prisoners no right to challenge BOP decisions in court. It also says the BOP should bring compassionate release motions to court whenever a prisoner presents compelling arguments, regardless of whether prison officials believe early release is warranted.

The BOP's budget is more than $6 billion, and care of ailing and aging prisoners is a major factor in rising expenses. The report says one way to curb these costs would be increased use of compassionate release for prisoners posing minimal risk to public safety.

The report says the BOP does not keep an overall count of prisoners who seek compassionate release, but provided a breakdown for the Federal Medical Center in Butner, N.C., which houses nearly 1,000 inmates with medical problems. During 2011, the report says, the warden made decisions on 147 requests for compassionate release and approved 12 of them.

Based in 2010 figures, the per capita cost of caring for a prisoner in a medical center such as Butner was $40,760, compared to the BOP's overall per capita cost of $25,627, the report said.

The BOP requires prisoners to be within 12 months of death or profoundly and irrevocably incapacitated to be eligible for compassionate release consideration. It generally does not make motions to the courts on non-medical grounds, though the report says this could be done ? for example, for prisoners seeking early release to care for dying family members.

The report acknowledges that many Americans oppose early release, especially for offenders who inflicted serious harm on victims. But it argues that a prison sentence that initially seemed justified may become disproportionately severe due to changed circumstances, such as grave illness.

"Keeping a prisoner behind bars when it no longer meaningfully serves any legitimate purpose cannot be squared with human dignity and may be cruel as well as senseless," the report says.

Mai Fernandez, executive director of the National Center for Victims of Crime, offered this advice to the BOP: "We hope that, in fairness to victims, any compassionate release process provides notice to victims and the opportunity for them to be heard."

Many states have laws permitting early release for medical or other reasons, but Fellner said these provisions were "greatly underutilized" in most states.

The report cites several examples of inmates who unsuccessfully sought to have early-release requests considered by the courts.

Among them is a 73-year-old inmate at the Butner medical center who has served half of a 20-year federal sentence for sexually touching a child, taking lewd pictures and possessing child pornography. Because of a spinal condition, the inmate is now permanently paralyzed below his upper chest and will require skilled nursing care until he dies, according to the report.

The report says Butner's warden rejected his bid to be considered for early release, contending that he was still deemed a threat to society who deserved to stay imprisoned out of deference to his victim.

ALBUQUERQUE (KRQE) - For the last few years Commissioner Michael Wiener has been in and out of the news a lot but not for his work on the Bernalillo County Commission.

Most recently it was when he lost his re-election bid this summer after a photo surfaced of him posing with prostitutes in a red light district in the Philippines.

"I was just there for a number of hours with my fiance and I wasn't doing anything wrong if I was, I wouldn't have posed for a picture," Commissioner Wiener said.

Last year it was for claims that he sexually harassed women at work and before that, he took heat for emailing a joke about the president, African Americans and prison rape.

The commissioner said all of it will be part of a screenplay he is writing.

"Trying to basically put what happened to me over the last four years and mostly in the last year in context with all the other things that have happened to other republican elected officials," he said.

In an interview with News 13 Thursday afternoon Wiener said the media is harder on republicans.

The title of his screenplay 'Double Standard'.

"There's a tremendous media bias toward republican officials in which their words are scrutinized their actions are held to a much much higher standard, democrats are given a pass on things," said Wiener.

He said he plans to shop the screenplay around in the Spring of 2013 once it is finished.

He believes the project will be a success and even has an idea on who should play the leading role, Charlie Sheen.

"The only reason I brought that up that wasn't me really speaking it was the fact that for the last 20 years of my life, everywhere I've gone I've had people tell me over and over and over again that I look an awful lot like Charlie Sheen," Wiener said.

The commissioner also told News 13 me he hopes to film here in New Mexico and also on location in the Philippines.

His last commission meeting is December 11th he says he has no plans to run for political office again.

U.S. Department of Agriculture (USDA) scientists have identified sources of Escherichia coli bacteria that could help restore the reputation of local livestock. Studies by Agricultural Research Service (ARS) scientist Mark Ibekwe suggest that in some parts of California, pathogens in local waterways are more often carried there via runoff from urban areas, not from animal production facilities.

ARS is USDA's chief intramural scientific research agency, and this work supports the USDA priority of ensuring food safety.

Even though most strains of E. coli are non-pathogenic, the bacterium is monitored by public health officials as an indicator of water quality. Cows are often seen as the culprits when E. coli is found in local lakes, rivers and other bodies of water.

Ibekwe, who works at the ARS U.S. Salinity Laboratory in Riverside, Calif., and his colleagues collected 450 water and sediment samples from 20 sites throughout California's middle Santa Ana River Watershed. The collection sites included urban areas, livestock feeding areas, parks, National Forest lands, and three wastewater treatment plants.

Then the scientists extracted E. coli bacteria from each sample and identified 600 different isolates of E. coli in their samples, many of which could be placed into six clonal populations. They found the greatest variety of different types of E. coli in runoff discharged from areas dominated by urban development or human activities.

Ibekwe also tested all the E. coli isolates for resistance to various antibiotics. He found that from 88 to 95 percent of the isolates were resistant to rifampicin, and that around 75 percent were resistant to tetracycline. Tetracycline resistance was by far the most common type of resistance observed in E. coli isolates collected near wastewater treatment plants.

The scientists also found that 24 percent of E. coli collected in sediment samples associated with urban runoffa total of 144 isolatesshowed resistance to as many as seven antibiotics. Results from this work were published in PLOS ONE.

Emmy winners "Homeland" and "Modern Family" lead Producers Guild TV nominees

LOS ANGELES (TheWrap.com) - Reigning Emmy champs "Homeland" and "Modern Family" will have a chance to add to their trophy cases at the 2013 Producers Guild Awards, which nominated both shows for the PGA's top honor in the drama and comedy series categories, respectively.

In nominations announced on Wednesday by the Producers Guild of America, the producers of "Homeland" will be competing for top drama series with "Breaking Bad," "Downton Abbey," "Game of Thrones" and "Mad Men."

In the episodic comedy field, Emmy winner "Modern Family" will be going up against "30 Rock," "The Big Bang Theory," "Curb Your Enthusiasm" and "Louie."

In the non-fiction television category, the field ranges from "Deadliest Catch" and "Shark Tank" to "American Masters," "Inside the Actors Studio" and "Anthony Bourdain: No Reservations."

The two late-night Jimmys, Fallon and Kimmel, will compete in the live/talk category against Bill Maher, Saturday Night Live and Stephen Colbert.

With the help of four nominations in the sports category, HBO led all networks with eight nominations. NBC and ABC tied for second with four, while PBS received three.

Nominations in all other categories will be announced on January 3, 2013. The Producers Guild Awards will take place on January 26 at the Beverly Hilton Hotel, with special honors at the ceremony going to Bob and Harvey Weinstein and Working Title's Tim Bevan and Eric Fellner.

For more than two decades, the CSA has provided music, art, drama, creative writing and dance lessons for members of the Clarksville community. This spring, the CSA will offer classes from January 7th through May 3rd.

WASHINGTON (AP) ? Senate Democrats rallied to U.N. Ambassador Susan Rice's defense as Republicans said they were even more troubled by her account of the deadly attack on the U.S. Consulate in Benghazi, Libya, and signaled they would try to scuttle her nomination if President Barack Obama tapped her as the next secretary of state.

"The personal attacks against Ambassador Rice by certain Republican senators have been outrageous and utterly unmoored from facts and reality," said Senate Majority Leader Harry Reid, D-Nev., who called the criticism unfathomable in light of disclosures from the intelligence community.

As congressional Democrats and the Obama administration delivered a full-throated defense of the possible diplomatic nominee, Rice was meeting Wednesday with Republican Sens. Susan Collins of Maine and Bob Corker of Tennessee. Corker is next in line for the top GOP spot on the Senate Foreign Relations Committee.

"We'll see and we're going to sit down and talk to her," Corker told The Associated Press. "She always delivers the party line, the company line, whatever the talking points are. I think most of us hold the secretary of state and secretary of treasury to a whole different level. We understand that they're going to support the administration, but we also want to know that they are independent enough, when administration is off-base, that they are putting pressure. I think that's what worries me most about Rice."

Rice answered questions Tuesday from Sens. John McCain, Lindsey Graham and Kelly Ayotte about her much-maligned explanations about the cause of the September attack in Libya that killed Ambassador Chris Stevens and three other Americans.

At the hour-plus, closed-door session, Rice conceded that her initial account ? that a spontaneous demonstration over an anti-Muslim video triggered the attack ? was wrong, but she insisted she had not been trying to mislead the American people when she made her comments five days later.

"The talking points provided by the intelligence community, and the initial assessment upon which they were based, were incorrect in a key respect: There was no protest or demonstration in Benghazi," Rice said in a statement after the meeting. "While we certainly wish that we had had perfect information just days after the terrorist attack, as is often the case the intelligence assessment has evolved."

She was joined in the meeting by Acting CIA Director Michael Morell.

Rice requested the meeting with the three senators ? her most outspoken critics ? but she failed to mollify them and they indicated they would try to block her nomination.

"We are significantly troubled by many of the answers that we got and some that we didn't get concerning evidence that was leading up to the attack on the consulate," McCain told reporters after a session with Rice that he described as candid.

Said Graham, "Bottom line, I'm more disturbed now than I was before that 16 Sept. explanation." He said in a later interview that Rice went "far beyond the flawed talking points" and should be held accountable.

"I'm more troubled today," said Ayotte, who argued that it was clear in the days after the attack that it was terrorism and not a spontaneous demonstration.

Rice's unusual visit to Capitol Hill ? typically only nominees meet privately with lawmakers ? reflects the Obama administration's campaign for the current front-runner to replace Secretary of State Hillary Rodham Clinton against some strenuous GOP opposition.

The White House remained defiant in its support for Rice, arguing that she was relying on an assessment from the intelligence community and had no responsibility in compiling the information on the cause of the attack. It dismissed what it characterized as a fixation on her national television appearances five days after the raid.

"The focus on, some might say, obsession on comments made on Sunday shows seems to me, and to many, to be misplaced," Obama spokesman Jay Carney told reporters at a White House briefing.

House Democrats, including female members of the Congressional Black Caucus, have suggested that the GOP opposition to Rice is sexist and racist. Senate Democrats, who will increase their advantage to 55-45 in the next Congress, said Rice could win confirmation if Republicans recognize the unfairness of penalizing her for the intelligence community's talking points.

Senate Armed Services Committee Chairman Carl Levin, D-Mich., told reporters "it is so unfair to hold her responsible for something that she didn't produce and which the intelligence community has specifically stood by."

In a statement late Tuesday, McCain, Graham and Ayotte said Morell told them the FBI had removed references to al-Qaida in the talking points to prevent compromising ongoing investigations. Later in the day, the three senators said the CIA contacted them to say Morell misspoke and the CIA had deleted the references.

Undergraduate researchers at Worcester Polytechnic Institute are studying antimicrobial peptides found in fish gills with the aim of creating engineered surfaces that kill bacteria responsible for foodborne illnesses and hospital-acquired infections

Worcester, Mass. -- Living in an environment teaming with bacteria and fungi, fish have evolved powerful defenses against waterborne pathogens, including antimicrobial peptides located in their gills. Undergraduate researchers at Worcester Polytechnic Institute (WPI) are studying the biology and the mechanics of one of those peptides with the hope they can use that knowledge to create engineered surfaces that kill bacteria responsible for foodborne illnesses and hospital-acquired infections.

The research team, led by Terri Camesano, professor of chemical engineering, reports its latest findings in the paper "Creating Antibacterial Surfaces with the Peptide Chrysophsin-1," published online in October by the journal ACS Applied Materials & Interfaces.

"Fish have a wonderful solution for blocking bacterial and fungal infections," Camesano said. "In this study, we are working to better understand the biochemical mechanics of that process."

As fish filter water through their gills to extract oxygen, antimicrobial peptides (AMPs), including Chrysosphin-1, trap and kill pathogens before they can invade the fish's bloodstream. Scientists in many laboratories around the world are actively exploring the potential use of these molecules to prevent human infections. In the current study, the WPI team attached AMPs to silicon and gold surfaces using two different approaches and measured the bound peptides' ability to kill the bacterial pathogen E. coli.

In the first method, the AMPs were absorbed directly onto gold and silicon crystals, forming a single layer of molecules with the AMPs lying flat on the surface. In the second method, the tips of the AMPs were attached to the surfaces with a glue-like substance so that the peptides rose vertically, like blades of grass extending up from the ground.

Surfaces with both AMP configurations were cultured with E. coli cells. The results showed that when the AMPs were lying flat they killed 34 percent of the bacteria in the culture, but when they were standing up vertically they killed 82 percent.

"The hypothesis is that when peptides are attached vertically to the surfaces, they are better able to move and bend so they take on a shape that is more effective in binding to and disrupting the E.coli cells," Camesano said.

In addition to gathering data about the antibacterial efficacy of the attached AMPs, the WPI research team developed a technique for monitoring, in real time, the attachment of AMPs to surfaces. Using quartz crystal microbalance with dissipation monitoring (QCM-D), the team measured the quantity of AMPs that successfully attached to the surfaces in the horizontal and vertical orientations and the density of the AMP layers, along with other properties.

"This was a powerful process, to be able to essentially watch the binding process as it happened," Camesano said. "It is a technique that we will continue to apply in further studies."

Camesano said gold and silicon surfaces were selected for the current study because their chemical properties are well-suited for AMP binding. In ongoing work, Camesano's laboratory will continue to characterize the mechanics of AMP binding for optimal antimicrobial activity and test other materials, including titanium, stainless steel, and plastics, that would have greater utility in food preparation and healthcare.

"What is also notable about this study is that it is the work of undergraduates," Camesano said. "They've done excellent work here that will inform future graduate studies in our lab."
